The Pennsylvania Office of Attorney General recently warned property owners about deed fraud and other property ownership scams. While the state emphasizes that these scams are not common, the consequences can be significant when they occur.
Deed fraud, sometimes referred to as home title theft, can involve someone using forged or fraudulent documents to falsely transfer ownership of a property. Other schemes may involve deceiving a property owner into signing documents that actually transfer ownership.
Pennsylvania Attorney General Dave Sunday summarized the seriousness of the issue:
“Scams today take many forms, and deed fraud is certainly one of the most devastating, as it involves someone losing their home.”
What Does Deed Fraud Look Like?
One scenario involves a criminal forging documents and attempting to record a fraudulent property transfer. Once that occurs, the property could potentially be used to secure financing, sold to another party, or otherwise exploited without the legitimate owner’s knowledge.
Another involves deception. According to the Pennsylvania Attorney General, scammers may approach homeowners with promises to help refinance a mortgage or resolve delinquent property taxes while actually presenting documents that transfer ownership.
The takeaway is straightforward. Never rush when signing documents involving your property. Understand what you are signing, verify who you are dealing with, and seek guidance from a trusted professional when something does not look or feel right.

Fraud prevention is another reminder of the important role professional title work plays in a real estate transaction.
Before property changes ownership, a title search examines public records to confirm ownership and identify potential issues including liens, judgments, prior mortgages, easements, and competing ownership claims.

A Free Resource for Pennsylvania Property Owners
Pennsylvania property owners may also have access to another useful tool. Many counties throughout Pennsylvania offer property monitoring or fraud alert services that can notify an owner when certain documents are recorded using their name or associated with their property.
The Pennsylvania Land Title Association provides a statewide County Title Monitoring resource that allows property owners to locate their county and follow the appropriate instructions to determine whether a monitoring service is available.
Depending on the county, property owners may be able to register for notifications when new documents are recorded. An alert does not necessarily mean fraud has occurred. Legitimate deeds, mortgages, and other filings can generate notifications as well. The benefit is simply knowing that activity has occurred so an unfamiliar filing can be investigated quickly.
These services do not replace title insurance and cannot prevent someone from attempting fraud. They can, however, provide another useful layer of awareness for Pennsylvania property owners.
